U.S.-Kazakhstan Peaceful Nuclear Cooperation Agreement

The United States and Kazakhstan signed an agreement for cooperation in the peaceful uses of nuclear energy today.

Section 123 of the U.S. Atomic Energy Act requires that significant nuclear exports from the United States only take place pursuant to an agreement for cooperation. This agreement opens the door for trade in nuclear materials, equipment, and technology between the two countries.

The agreement contains strict controls to prevent the spread of nuclear weapons:

* a prohibition on the use of items subject to the agreement for any nuclear explosive or military purpose;

* the application of International Atomic Energy Agency safeguards to all nuclear activities in Kazakhstan;

* a guarantee of adequate physical protection on all items subject to the agreement;

* a right of prior approval over reprocessing, enrichment, or other alteration in form or content, and (for weapons-usable materials) storage of nuclear material subject to the agreement;

* a prohibition against transfers under the agreement of restricted data or sensitive nuclear technology.

The agreement rests on a foundation of a strong commitment of the two countries to prevent the spread of nuclear weapons.

The Republic of Kazakhstan is a party to the Treaty on the Non-Proliferation of Nuclear Weapons. It has recently decided to adhere to the Guidelines of the Nuclear Suppliers Group.
